All applicants and titleholders must read and agree to the following: Talent/Model Release, Sweetheart Sportsmanship Policy, Titleholder Agreement/Contract, and Organization rules and regulations fully disclosed.

Talent/Model Release

This agreement is between Local/State Delegate, hereinafter referred to as the Contestant or delegate)", and America's Miss Sweetheart Organization Inc hereinafter referred to as the Pageant, AMS or the Organization:

 

I,  hereby assign full use and copyright of the images/videos submitted, taken, recorded, or shared with the pageant. I hereby irrevocably authorize America's Miss Sweetheart Organization to use photographs or video of me and or my property and authorize America's Miss Sweetheart Organization assignee, licensee, legal representatives, and any transferee to use and publish (with or without my name, title, nickname, or with a fictitious name) photographs/images or video herein described in any and all forms and media and in all manners including composite images or distorted representations, for the purposes of publicity, illustration, commercial art, advertising. publishing (including online or print), for any product or services, or other lawful uses as may be determined by the national pageant office of America's Miss Sweetheart Organization. I further waive any rights to review/approve any uses of the images, any written copy, or the finished product. I am of full legal age and have read and understood the terms of this release. I understand and give America's Miss Sweetheart full permission to use my likeness, voice, image/photo, or video will be used by pageants indefinitely at the organization's discretion without compensation.

Titleholder Contract & Obligations

America’s Miss Sweetheart Organization Inc.

This America’s Miss/Teen Sweetheart Contestant Agreement (the “Agreement” or “Contestant Rules & Regulations”) states the terms and conditions that govern the contractual agreement between America’s Miss Sweetheart Org. Inc. and me, the contestant who agrees to and accepts the rules and conditions of America’s Miss Sweetheart Organization/The National Pageant Draft. WHEREAS, America’s Miss Sweetheart Organization reserves the right to update and modify the contestant rules and regulations at any time. NOW, THEREFORE, In consideration of the mutual covenants and promises made by the parties hereto, America’s Miss Sweetheart Organization and the contestant- agree as follows:

Teen Division Terms & Requirements

Teen delegates must be single, never have been married, or have the marriage annulled. Teen delegates must never be pregnant or have a child. Delegates must be natural females and live as a female. Teen Delegates must meet the following age requirement being not younger than 13 years old as of the start of national competition and no older than 19 years old by the national pageant event of the calendar year.

Miss Division Terms & Requirements

Delegates must not be married. Miss delegates may be divorced or engaged but not legally married during the time of participation. Miss delegates may have had a marriage annulled or be engaged to marry after contract obligations are complete. Delegates cannot be pregnant. Miss delegates may have adopted or birthed a child. Delegates must be natural females and live as a female. Miss Delegates must meet the following age requirement being not younger than 19 years old as of the start of national competition and no older than 32 years old by the national pageant event of the calendar year.

 

 

Must be of good moral character and an upstanding US citizen. Delegates must abstain from any controlled dangerous substances during the reign. Teen/Miss Delegates must not have an arrest or criminal conviction. The use of profanity, foul, or abusive language at any time in public is strongly prohibited. The use of vulgar, inappropriate, profane, foul, abusive, risqué, alcohol (or the appearance of), tobacco (or the appearance of), drug (or the appearance of), or sexual content, language, photographs, comments, or posts on any internet website or social media platform is prohibited. This includes content on any page owned by anyone. Any and all pictures and comments not following these guidelines MUST be taken down. At any time the AMS Organization reserves the right to discuss any content we deem inappropriate. Delegates shall not engage in public displays of affection by male/female companions while representing America’s Miss Sweetheart Org. AMS strictly prohibits the consumption of any alcohol, tobacco products, or illegal substances while representing America’s Miss Sweetheart Organization. This includes any and all sponsored events of the AMS Organization or sponsored events. (Initials)

 

No refunds paid to America’s Miss Sweetheart Inc. will be made. The state crown and sash must be returned to America’s Miss Sweetheart Inc, in the condition it was awarded within 14 days if an agreement is terminated for any reasons. All social media accounts and titleholder email access will also be rescinded, if an agreement is terminated, immediately. Titleholders are not permitted to change passwords to any official pageant accounts assigned (social media or email). If the state titleholder does not compete at the national pageant, the official state crown and sash must be returned in the condition it was awarded within 7 days. State Titleholders may not compete in another pageant system during the duration of a state title. America’s Miss/Teen Sweetheart Org., expects its titleholders to be loyal spokeswoman to the AMS system for the full duration of their reign. I understand if the said winner of the national title of America’s Miss/Teen Sweetheart, I will be ineligible to compete in another pageant system for the duration of my reign until the crowning of my successor at the next national pageant event. I understand that America's Miss Sweetheart Org., Inc. may change the date and/or location of the State/National Competitions as deemed necessary. I will comply with safety and health guidelines to protect myself and others. AMS reserves the right to change the competition format as necessary to fully oblige by any government/local regulations due to the COVID-19 pandemic*. I further agree that at no time shall I wear or be photographed in any crown that is not designated as the official crown of America’s Miss Sweetheart, Inc. with my official America’s Miss Sweetheart sash. Likewise, I agree that at no time shall I wear or be photographed in any sash that is not designated as the official sash of America’s Miss Sweetheart Org., Inc. with my Official America’s Miss Sweetheart Crown.

 

Contestants shall act at all times with due regard to high moral standards, character, and integrity. If contestant shall commit any act, or if State Titleholder shall have conducted or does conduct herself in a manner, which shall be an offense involving poor moral conduct under federal or state or local laws which might bring the State Titleholder to public disrepute, contempt, scandal or public ridicule or which may embarrass, offend, insult or denigrate individuals or groups within America’s Miss Sweetheart Inc. or sponsors, or that may shock, insult, offend the community or pageant organization or decency or which results in or is likely to result in actual or threatened claims against America’s Miss Sweetheart Organization, reserves the right to terminate this agreement upon notice to the State Titleholder at any given time following the date on the commission of such act(s) or such conduct(s) with understanding the official state crown and sash must be returned within 14 days in optimum condition.

 

The AMS Organization agrees that it shall provide its expertise and support to the State Titleholder for all things pertaining to [America’s Miss Sweetheart] the Titleholder Services. America’s Miss Sweetheart Inc or its National Directors or staff is not responsible for any sponsors' unfulfillment of any prizes, gifts, or services. I am committed to representing my state at the National Finals. I agree to forever hold America’s Miss Sweetheart, Inc., its directors, employees, volunteers, and staff members are harmless of any and all claims and damages or liabilities due to theft, accident, illness, loss, or injury during or resulting from my participation in the Finals or any Preliminary/State/Regional or activity/event. I understand that failure to compete at the national pageant if selected as a state representative would result in a withdrawal fee ($900) due upon invoice receipt and the contestant must return state crown and sash and I understand I forfeit my claim to prizes or awards. May be subject to return any or all sponsored gifts. The contestant is committed to complying with the service project requirements of America’s Miss Sweetheart Organization. Requiring consistent and meaningful non compensated volunteer service, in-person or virtual events/fundraisers, twice per month throughout the reign. The Parties acknowledge and agree that America’s Miss Sweetheart Organization holds all intellectual property rights in any work or products from America’s Miss Sweetheart Inc., including, but not limited to, copyright and trademark rights, logo, crown, and sash. The titleholder agrees not to claim any such ownership in such work products intellectual property at any time prior to or after the completion of reign. All documents and materials are not to be reproduced or shared in any form without written permission from America’s Miss Sweetheart. I give permission to America’s Miss Sweetheart, Inc. to forever use my photographs, speeches, testimonials, official social media account posts, videos, etc. for publicity purposes and future material without compensation. I understand that there is a $35 charge for a non-sufficient funds check and that all unpaid non-sufficient funds checks will be reported to the County District Attorney's Office. (Initials).

 

Contestants shall not disclose to any third party any details regarding America’s Miss Sweetheart business, including, without limitation any information regarding any of the titleholder information, business plans and paperwork (ii) make copies of any Confidential Information or any content based on the concepts contained within the Confidential Information for personal use or for distribution unless requested to do so by the pageant office, or (iii) use Confidential Information other than solely for the benefit of the organization

 

I understand that all fees paid to America’s Miss Sweetheart, Inc. are NOT REFUNDABLE and NOT TRANSFERABLE in full or in part under any circumstances.

 

I understand that I may not alter my sash in any permanent way including but not limited to adding my name to the back of the sash unless approved in writing by the National Office. I understand that if this rule is broken, I must replace my sash at my own expense if damage occurs or desired replacement. Any damage to my official crown and sash may result in replacement fees and shipping fees. I understand that I am responsible for paying or setting up a payment plan for the National Sponsorship Fee within 14 days of being awarded the state title. I understand that fees must be paid in full before I am able to compete. Payment plans are available through the Pageant Office and must be made in advance.

 

Delegates are required to support and represent our national platform (vision and mission) and charity partners like St. Jude Children’s Research Hospital (SJCRH) along with your personal platform during the duration of State Titleholder reign.

 

No modification of this Agreement shall be valid unless in writing and agreed upon by both Parties

This agreement and the interpretation of its terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania and subject to the exclusive jurisdiction of the federal and state courts located in Monroe County, Pennsylvania.
